A Retired FBI Agent Addresses James Comey on the Hillary Clinton Investigation

Sir,

I am writing regarding your public statement in July, 2016 informing the American people that the FBI investigation of Hillary Clinton was being closed without referring it to a Federal Grand Jury or the Attorney General of the U. S. for a decision whether or not to indict her. Strangely, you eloquently laid out enough of the evidence deduced from the investigation to strongly indicate there was abundant evidence uncovered during the investigation and interview of her to not only indict but to convict her in  Federal Court.­­­­­­­ ­­­­­­However, you personally  re-worded and soft-pedaled the actions she took as Secretary of State describing her actions as “extremely careless” in using a personal email and un-secured server for her communications while Secretary of State. You rewrote the statute, which is not your job.

As a retired Special Agent of the FBI, I have standing to write this letter. My thirty years in law enforcement, including 22 years as a Special Agent with the FBI have given me the knowledge, expertise and experience to question and confront you for your perplexing actions, which (as you well know) were outside the normal standard operating procedure of the FBI and Federal judicial procedures. Some of the finest people in the world proudly carry the credentials of FBI Agent and you have soiled them and not allowed them to speak. But I will not be silent.

Sorry, but NO SIR, MS Clinton was not merely careless or extremely careless. She was not even negligent or grossly negligent (as the statute requires). Hillary Clinton was knowingly purposeful in her decisions and actions to set up a server under her exclusive control and possession in order to control what information was available to the American public and Congress regarding her actions as Secretary of State. Furthermore, she took those government owned communications into her personal possession after leaving her position and knowingly and willingly attempted to destroy them so her nefarious actions could never be known or used as evidence of her corrupt moral character against her.

Sir, what possessed you? Did you cave in to political pressure to unilaterally come to this decision? I fear that is the case, and Rule of Law be damned. I am embarrassed for and ashamed of you. You have set a precedent that can never be rectified… and certainly not justified. Shame on you, Sir. You ought to resign right now in disgrace for what you have done to tarnish the reputation of the finest Law Enforcement Agency in the world… for entirely political reasons.

Normally, an investigation will be assigned to an agent, or team of agents with one being the Case agent, or the lead investigator. When the investigation is complete, an investigative report will be presented to the U.S. Attorney for the Federal District involved.  It would be the U.S. Attorney who decides whether to decline prosecution for that investigation… NOT the FBI agent. But in the Clinton investigation, YOU (unilaterally) decided not to forward the investigation to the U.S. Attorney or the Attorney General of the U.S., but instead personally made the decision not to prosecute her or even provide the information to a Federal Grand Jury.  You were wrong to take this upon yourself.

Sir, in order to indict a subject, only a preponderance of evidence, or 51% is needed for probable cause to exist. You did not think even that level of probability existed? Who do you think you are fooling? What judicial proceeding did you think you were following?

Throughout my years with the FBI, I (along with my fellow agents) took great pride in conducting each investigation in an unbiased manner regardless of the subject’s position or standing in the community.

All were treated equally under the law. But you, Sir, decided to allow this corrupt, evil and nasty human being to go free and unchallenged for her treasonous actions (yes, treasonous, in my opinion) which threatened the security of this nation. Furthermore, you stopped short of investigating the Clinton Foundation as a RICO case (Racketeering Influenced and Corrupt Organization.  This is a RICO case if there ever were one. Even an untrained person can tell from the communications which were recovered that Hillary Clinton spent more time working for the Clinton Foundation while Secretary of State than on State Business.  It may be argued that Hillary did not do any State business UNLESS the Clinton Foundation benefitted.  You decided to just let this uncomfortable truth alone without addressing it.

I will conclude with this:  Following my retirement from the FBI, I volunteered for a 12 month tour of duty in Afghanistan as a Law Enforcement Professional, embedded with U.S. forces as a subject matter expert in counter-terrorism investigations.  For most of that year I operated “outside the wire” patrolling with the troops, interviewing witnesses to IED incidents and gathering evidence on the bad guys.  The results of my work would then be reported through secure channels to the Commanding Officer.  All reports and communications were required to be transmitted via secure and encrypted devices.  Occasionally my remote location in the mountains of Afghanistan made transmission impossible and I would have to fly back to Bagram Air Base in order to securely report to the Commander of the battle space.   It would have been convenient if I could have just called the Commander on my personal cell phone or written him an email on my personal laptop.  But, had I done so I would have been reporting classified information via an unsecured device and it could have been compromised. These were, relative to Secretary of State communications, low level classifications of Secret.  Had I ever sent even one in such a manner I would have been prosecuted and sent to Federal Prison for 20 years or so.  That is how serious this violation is considered.

Now, because of you, Hillary Clinton is allowed to continue her RICO activities and is running for President of the United States, the most powerful position in the world.  You have trampled on the Rule of Law and destroyed the trust of the American people in the FBI and in unbiased enforcement of the law.  How do you sleep at night? It is time for you to go and work for the Clinton Foundation.

There is nothing that I could say that would improve on the tongue-lashing just administered to Mr. Comey by Mr. Galyean. In my humble opinion, Mr. Comey had it coming and it’s somewhat satisfying to see a career FBI agent with Mr. Galyean’s credentials spell it out so well. He said what many of us on the outside were thinking and reinforced that Comey has single-handedly brought disgrace to a federal agency previously held in high esteem by the public. Mr. Galyean’s letter reminds us that we shouldn’t disparage the entire FBI because of a miscarriage of justice carried out by a corrupt agency head.

  1. Bottom line: We no longer have law enforcement agencies, we have political policy agencies, enforcing the policy agenda of whichever party elites happen to hold the reigns of power. The political decisions by those directing “law” enforcement determine who to punish and who’s crimes to disregard, especially in cases involving one of their own,

    Our constitutional system of law is well beyond the tipping point, and as a result, it’s unlikely we’ll see anything close to the “rule of law” in this country again until the deeply entrenched political oligarchy of elites has been overthrown. Good luck with that. Apparently, given the nominees for POTUS we have out of a field of their betters, there’s really no serious political will of significance to put a stop to this.

    • I’d agree with your comment except for one point – where you seem to automatically equate the two parties “whichever party” holds power. That may be true to some extent, but there is more corruption in this current regime (a democrat one) than ever before and while the next Republican one (if there is another Republican administration) may be just as bad – that remains to be seen. The corruption under Bush wasn’t as evident or as public so there’s little reason to believe that it was just as evil.

      • I do think the letter was excellent, just meaningless in the scheme of things. I don’t think there’s a good case to be made based on one party being more corrupt than the other. What is evil and corrupt isn’t a matter of degrees, it is evil and corrupt because it is, and the effect of evil and corrupt in government is cumulative… one road may be obvious, Democrat, but to me, the more insidious road is the one that isn’t so obvious — Republican. Mitch McConnell and John Boehner had one opportunity after another — with the wind at their backs — to stop Obama via impeachment, based on his openly and blatant unconstitutional actions, his administration’s complete stonewalling of congressional investigations into fast and furious, Benghazi, the IRS targeting program, contempt of congress, flouting the law at every opportunity, the list goes on, and they did nothing more than write letters to the Sup. Ct and/or complaining to Mr. Obama. Result: NADA, Goose eggs. The agenda marched on.

        The Senate and House were/are in Republican control, they held/hold all the cards. Short of impeachment, they could have stopped Obamacare and all of the out-of-control spending by utilizing the constitutional mechanism given them — the power of the purse, but again they did nothing. Moreover, they rubber-stamped virtually every lower court nomination to the Federal Bench that Obama put forward, which actually constitutes a bigger threat to our liberty day-in-day-out than SCOTUS — which in and of itself is corrupt because they were not defending the constitution first uber alles. There’s a better case for inter-party collusion than for one party being less corrupt than the other. And since Boehner left, Paul Ryan has proven himself just as useless, he just looks and sounds nicer.

        Republican John Roberts, allegedly a conservative Justice, had two perfect opportunities to stop the unconstitutional Obamacare in its’ tracks, which even a high school-aged conservative could see was the framework for a silent coup, not a healthcare plan. There is no Us vs. Them where the corruption of both parties is concerned, both are corrupt and neither will ever do the right “conservative” thing until that oligarchy which includes the establishment elites controlling congress, the courts, the justice dept — from both parties — is dismantled.

        I doubt seriously that the small business owner, or the family scrimping to make ends meet and has the burden of thousands of dollars a year in a virtually useless healthcare plan because between the monthly premiums of 1000.00 to 2000.00 per month and another 5000.00 to 10000.00 in annual deductibles which take’s one really good full-time job or several part time jobs just to pay for, is going to care whether one party is more or less corrupt than the other party. Either way, the corruption that exists in both parties is what brought this down on them, and they will not be able to vote their way out of it so long as the elite power structure in DC and even in state government continues to thrive by tag-teaming against voters that think there is no alternative by which to break the two-party lock on our lives, liberty, and property. It’s time our representatives and other elected officials stop doing the “political” thing and start doing the right thing.

      • While I agree with much of what you’re complaining about, I can’t agree on one point – that evil and corrupt aren’t a matter of degree, of course there are variations in the seriousness and impact of levels of corruption (and evil).

        I don’t see how you can say that once something is evil or corrupt, everything falling into that evil and corrupt category results in the same level of pain to the citizenry. Some forms of evil/corruption are more insidious and damaging than other forms.

        McConnell and Boehner were both worthless and shouldn’t have been in their respective positions, I won’t argue that, but to equate their inaction to the active, intentional measures taken by Barack Obama to circumvent our Constitution can’t be compared. True, they were corrupt and didn’t do what their constituents wanted them to do, but you’re saying that their corruption rose to the level of Harry Reid and Nancy Pelosi? I don’t think so.

        Don’t misunderstand, I’d boot McConnell tomorrow if I could and the Senate didn’t act as we wanted because of his corrupt leadership (along with several others of his ilk). I just see him as a wimpy weak leader of a crowd of corrupt politicians who just want to keep their cushy jobs and make a pot of money at the same time. I honestly don’t see them as anti-American like Obama – or Hillary Clinton, for that matter.

      • You misunderstand Garnet92, and by the way, I’m not “complaining” about anything! Rather, I’m pointing out an observable truth… the evil and corrupt are the ones in control of both parties regardless how many well-intended or “good” people there are in the parties. The overt party of evil and corruption is the Democrat party because their faithful are Marxist and Marxism does not recognize evil, for them evil is in the eye of the beholder,so they’re okay with what we see as evil and always have been — no surprise they will vote Hillary, or Obama or whoever, because they just don’t care.

        On the other hand, while there are far and away fewer “evil” constituents in the Republican party, which means the party elites have to worry a little more about what they say and how they say it to smooth over with a velvet glove what they are really doing — it appears that the Republican party is less corrupt. BUT! The goals of both parties are the same, a homogenous ruling elite manipulating the outcome of every election to their own advantage.

    • Comey talked the tough game like he was doing his job but left wiggle room for his own defense after his nutty excuse. This was set up. The bizarre meeting at the airport with the thoroughly tainted AG was set up to guard against putting anything on the record. Pretty easy to follow that corruption tactic right into the admin and the Clintons. They’ve used the same word parsing legal games many times knowing they are well protected… for now.

  3. A very good letter by Mr. Galyean, and he basically answered his own question – Comey caved to political pressure.

    But then we have watched this trend go on for eight long years. There’s not been a single department head that hasn’t defied and ignored our laws at O’s behest. Not a single one of them has stood up to him and told him no and Comey’s no different.

    It’s good to remind us not to disparage the whole department, but the FBI will have to deal with the tainted reputation for a long time – it’s just the nature of the beast.

    • Regardless of what our black population thinks of their “brutha,” most of us who’ve been paying attention recognize corruption when we see it. They’ll immediately label it as racism, but Barack Obama is still half white (sorry to say) and his actions would be just as despicable if he was lily white. He has caused more harm to the United States since he’s been in power than any other president in my lifetime (and I’m an old guy). I’d have happily taken Jimmy Carter back if I could have – he was merely incompetent, a fool, while Obama is intentionally destroying the U.S. from within.

      Benedict Arnold was an Eagle Scout compared to Barack Obama.

There is no doubt whatsoever that James Comey succumbed to corruption and stood between Hillary and justice for the American people. Zero doubt.

      The disturbing thing is – a large percentage of the American public understands what happened here and they know that Comey succumbed to the Clinton Crime Family, regardless of whether the influence came via carrot or stick, he was bought plain and simple. It’s apparent that Comey has reconciled with that.

    • That WAS a great letter. I think that it took the right tone and was simple and straightforward in his statements – it’d be pretty hard for Comey to refute. All he can do is maintain that he was impartial.
